Terms of Service
1. Who we are
These Terms govern your use of Sendawick (the "Service"), operated by Parais Gergely, a sole proprietor (egyéni vállalkozó) registered in Hungary, registration number 62671981, tax number 92279441-1-27, registered seat: 8045 Isztimér, Jókai utca 3., Hungary ("we", "us", "Operator"). Contact: hello@sendawick.com. Hosting provider: Cloudflare, Inc., 101 Townsend St, San Francisco, CA 94107, USA.
2. What the Service does
The Service lets you create a personalised, animated greeting web page (a "Page" or "card") for an occasion such as a birthday, an anniversary, a declaration of love or a question. You provide the recipient's first name, your name, the occasion and a few short details in free text, and you choose the animation, the colours and the type. The Service combines a pre-designed animation with text written with the help of an artificial intelligence model (Anthropic Claude) to produce the Page. On every plan you may hide a gift at the end of the Page (a code, a note or a link you provide; we do not sell, provide or check gifts). On the Premium plan you may add up to 10 photos of your own (up to 20 on the Extra plan), a short generated tune, a voice message of up to 30 seconds, a hand-drawn signature and a link to a song on Spotify or YouTube. On the Extra plan you also receive a collect link: friends who open it can add their name and a short wish, which appears on the Page after the animation, and you can hide any line with a private link we e-mail you. Extra also includes extra animations (such as fireworks, living paint, wish lanterns, a snow globe and a 3D gift box), a scene background, a countdown page for scheduled delivery, an optional yearly reminder e-mail (for birthdays, name days and anniversaries) and, once rendered, a downloadable video file of the Page. Extra also lets you add a short quiz for the Recipient (their score is e-mailed to you after their first try), up to 12 "open when" letters (openable at any time, or one a day from delivery), and a money-gift envelope. The money-gift envelope only displays an amount, a line and, if you add one, a link you provide: we do not receive, hold or transfer money, and any transfer happens between you and the Recipient through the provider you choose. The advent calendar occasion is available only on the Extra plan: it has 24 windows, one of which opens each day from 1 to 24 December in your time zone; until its day, the content of a window is not sent to the Recipient's device. The "Our year" occasion is available on the Premium and Extra plans: a book the Recipient pages through, made of the numbers, top lists and photo captions you type; the AI can suggest the short line on each page (up to three times per card), and you can rewrite any of them. On its last page the Recipient can save a picture of the summary; the picture is made on their device and is not uploaded to us. You see a watermarked preview before you pay. After payment you receive a unique link to share with the person the Page is for (the "Recipient"). The Recipient may send a short reply (for example "Yes" or a few words) back to you through the Page, and, if you bought the Premium or Extra plan, may make one card in return free of charge (a "reply card", with the features of the Basic plan), whose link we e-mail to you. Basic cards do not include a reply card.
3. Eligibility
You must be at least 18 years old and able to enter into a binding contract to purchase a Page. By ordering you confirm this. The Service is not directed at children. A Recipient may be of any age, but content about a minor must comply with our Content Policy.
4. Plans, price and payment (Merchant of Record)
Three plans are offered: Basic (USD 4.99, link live for 365 days), Premium (USD 12.99, link live for as long as the Service operates) and Extra (USD 19.99, as Premium plus delivery at a time you schedule). Prices are shown in US dollars; the final amount, including any VAT or sales tax that applies in your country, is shown at checkout before you pay. Purchases are processed by our Merchant of Record, Sold through Link, LLC (formerly Lemon Squeezy LLC), 222 Main Street Suite 500, Salt Lake City, UT 84101, USA ("MoR"). The MoR is the seller of record for your purchase: it charges you, issues your invoice or receipt, collects and remits applicable taxes, and handles refunds and chargebacks under its own terms (https://www.lemonsqueezy.com/terms). No account is required; your order is linked to the e-mail address you provide. Packs: you can also buy 3 Premium Pages (USD 29.99) or 5 Basic Pages (USD 17.99) in advance. A pack is delivered as one code by e-mail; each use of the code activates one Page on that plan instead of a payment, and the code can be used until one year after purchase. Pages not used by then lapse without refund. We store only a fingerprint of the code, so keep the e-mail.
5. Immediate delivery and the right of withdrawal (EU/EEA and UK consumers)
The Page is digital content that is not supplied on a tangible medium. The link goes live automatically as soon as the MoR confirms your payment. Before you can order, you tick a box stating that you ask us to start right away and that you understand that you lose your 14-day right of withdrawal once the Page is delivered (Directive 2011/83/EU, Art. 16(m); in Hungary Government Decree 45/2014 (II. 26.), Section 29(1)(m)). We repeat this acknowledgement in the e-mail that brings you the link. If you do not tick the box you cannot complete the order. For a pack, you ask us to send the code right away; you may withdraw from the pack within 14 days of purchase as long as you have not used the code, and you lose that right once you use the code for a Page. This does not affect your statutory rights where the Page is defective (Section 11) or our voluntary Refund Policy (/legal/refunds.html).
6. Link lifetime
A Basic Page is available for 365 days from payment. A Premium or Extra Page is available for as long as the Service operates, unless it is removed earlier under Section 9 or at your or the Recipient's request. We will give at least 90 days' notice by e-mail before discontinuing Premium and Extra Pages. An unpaid preview stops being available 72 hours after it was created. After expiry, Pages are deleted as described in our Privacy Policy.
7. Your Content and licence
"Content" means everything you provide (names, occasion, details, photos), the wishes your friends add through the collect link, and the text the Service generates for you. You keep any rights you have in your Content. You grant us a non-exclusive, worldwide, royalty-free licence to store, process (including through our AI and hosting providers), reproduce and display your Content solely to create, host and deliver your Page and to operate the Service. You may use your finished Page for personal, non-commercial purposes. We do not claim ownership of the generated text and make no promise that it is unique.
8. Your responsibilities
You confirm that: (a) you have the right to use every name, detail and photo you provide, and that every person shown in a photo has agreed, or you are otherwise entitled, to have their likeness used in this way; (b) the person the Page is about would not reasonably object to having their name and the details you gave used in this way; (c) you have a lawful basis to share the Recipient's personal data with us; (d) your Content complies with our Content Policy (/legal/content-policy.html); and (e) you will not use the Service to harass, deceive, threaten or humiliate anyone. You are responsible for the Content you provide and for how you share the link.
9. Content rules, moderation and removal
We do not read Pages routinely. Our AI provider's safety systems may refuse to write text for certain requests, and we review a Page when someone reports it. We may refuse to generate, suspend or remove a Page, and may block the associated e-mail address, if we reasonably believe it breaches these Terms, the Content Policy or applicable law, or if the Recipient asks us to remove it. Where the law requires (including Regulation (EU) 2022/2065, the Digital Services Act), we will tell you the reasons and how to contest the decision. Anyone can report a Page by e-mailing hello@sendawick.com with the link; a Recipient can remove the Page about them at any time with the "Do not show this card again" button at the bottom of the Page. Our single point of contact for authorities and users under the Digital Services Act is hello@sendawick.com, available in English or Hungarian. Moderation decisions are taken by a person (the operator), not by automated moderation of hosted content. We confirm receipt of every report and tell the reporter our decision. When we restrict content, we send you a statement of reasons (what was restricted, the facts, the legal or contractual ground, and how to contest it: by replying to us, or before the courts). We notify the competent authorities of information giving rise to a suspicion of a criminal offence involving a threat to the life or safety of a person. Details: Content Policy.
10. Artificial intelligence
The personal text on your Page is generated by an AI language model from the details you provide and is then rendered into a template. AI text can contain mistakes or wording you do not like. Always review the preview before paying; if a line is off, go back, adjust the details and preview again. See our AI Disclosure (/legal/ai-disclosure.html). We do not use your Content to train AI models, and our AI provider is contractually prohibited from doing so.
11. Conformity, defects and our liability
We will deliver the Page substantially as described and as shown in the preview. If the Page does not work (for example the link does not load or the animation is broken), tell us at hello@sendawick.com; we will fix it, regenerate it or, if that is not possible, refund you, in line with Directive (EU) 2019/770 and applicable national law. To the extent permitted by law, we are not liable for indirect or consequential loss, for the reaction of the Recipient, for Content you provide, for the temporary unavailability of third-party services (hosting, AI, payment), or for any amount above the price you paid. Nothing in these Terms excludes liability for death, personal injury, fraud, gross negligence or intent, or limits mandatory consumer rights in your country of residence.
12. Availability
We aim to keep the Service available but do not guarantee uninterrupted operation. We may change templates and features, and may discontinue the Service with the notice described in Section 6.
13. Privacy
Our Privacy Policy (/legal/privacy.html) explains how we process your personal data and the Recipient's personal data. Please read it before you order.
14. Intellectual property of the Service
The templates, animations, code, design and branding of the Service belong to us or our licensors. You may not copy, resell or reverse-engineer them. Fonts and other third-party assets are used under licences that permit their display in your Page only.
15. Termination
You may stop using the Service at any time and ask us to delete your Page. We may terminate your access for material breach of these Terms; any refund in that case is governed by the Refund Policy.
16. Changes to these Terms
We may update these Terms for legal, technical or business reasons. Changes apply to orders placed after the effective date of the new version. The version applicable to your order is the one in force when you paid; the version number and effective date are shown at the top of this page.
17. Governing law and disputes
These Terms are governed by Hungarian law, without prejudice to any mandatory consumer protection rules of the country where you habitually reside. If you are a consumer resident in Hungary and we cannot settle a complaint, you may turn to the conciliation body (békéltető testület) competent for your place of residence or for our seat; for our seat this is the Fejér County Conciliation Body (Fejér Vármegyei Békéltető Testület, bekeltetes.hu). Consumers in other EU countries may use the alternative dispute resolution bodies available in their country. Courts: the courts of Hungary or, for consumers, the courts of your country of residence where the law so provides.
